These Terms and Conditions apply to any Yoga Activities (see definition below) purchased from Warrior Flow School (“Warrior Flow School LLC” or “Company”) and govern the contractual relationship between you (“You”, “I” or “Student”) and Warrior Flow School with respect to any such Activities.
PARTICIPATION
Paying for a program and completing the hours alone does not mean I will pass the program. I understand that if I am paid in full and fulfill all the requirements of the Warrior Flow School training I will receive a diploma as evidence that I have completed and passed the Online Training.
I understand that Warrior Flow School reserves the right at any time to ask me to leave the training if the instructor feels that I pose a risk to the physical safety to the instructor or other students or if I am compromising the learning process of the group. Under such circumstances, I understand I will be given a prorated refund, based on the amount of time I have attended in the training.
I understand that Warrior Flow School reserves the right to ask me to leave the program if I am found plagiarizing, if my behavior is disruptive, inappropriate, negatively impacting other students learning, unethical or violates the Yoga Alliance ethical guidelines. Under such circumstances, I understand I will not be refunded any part of my tuition.
I understand that Students are responsible for assessing their own suitability and capability to participate in a Program. All Students should consult their physician regarding their physical fitness level, mental status and any other special conditions they may be working with. It is the Student’s responsibility to assess the risks and requirements of each Program.
If this is an online training, I understand that it will be taught through pre-recorded videos or live, via Zoom or other online platform and will be an interactive experience. To make the most of this Online experience, I understand I am required to have reliable wifi connection and a laptop or other working device to participate in the training.
I understand that I must report any disability requiring special attention at the time the reservation is made. Warrior Flow School will make reasonable attempts to accommodate the needs of any participants, but is not responsible in the event it is unable to do so.
CLIENT AGE REQUIREMENT
I understand that I must be at least 16 years old to take the teacher training. If I am between 16 and 18 years of age, it is required that I provide written consent from my legal guardian 30 days before the start of the training.
PAYMENT AND REFUND POLICY
200-hour & 300-hour Online Yoga Trainings
Full payment is required by the start of the program unless a payment plan has been arranged.
If you cancel 8 or more days before the start of the program, you will receive a full refund. If you cancel within 7 days of the start of the program, you will forfeit 10% of your full payment and the remaining balance will be refunded. This 10% is non-refundable and non-transferable. Once the program begins the full program tuition is non-refundable and non-transferable.
We understand life circumstances can make it difficult for you to participate in the training as expected. You have the possibility to move to a future cohort (we run the training multiple times per year) for a single non refundable fee of 10% of the regular price. Note that in this case, you will start the training from the beginning, previous progress or submitted assignments won't be taken into account.
On the rare occasions when Warrior Flow School needs to cancel a training, a full refund will be provided.
Training has to be completed maximum 30 days after the official end date of the training.
If you are not able to complete the training during this time frame, you can request an extension to finish the training and receive your diploma, or you can move to another cohort (see above).
The entire curriculum will be online for all students, for a period of 12 months.
If you do not meet all the requirements to complete the training, you will not receive a passing status and therefore the certification.
Other trainings apart from the 200-hour & 300-hour Online Yoga Training
Full payment is required by the start of the program unless a payment plan has been arranged.
The trainings are non-refundable and non-transferable.
On the rare occasions when Warrior Flow School needs to cancel a training, a refund will be provided.
Mentoring, Stay Connected and 200-hour or 300-hour Online Yoga Training Renewal Packages
Full payment is required before the content of the package can be accessed unless a payment plan has been arranged.
The packages are non-refundable and non-transferable.
On the rare occasions when Warrior Flow School needs to cancel a package, a refund will be provided.
CHANGES
Warrior Flow School reserves the right to change, alter, or amend the program, including without limitation, the curriculum for each training at any time. The Warrior Flow School will make its best efforts to communicate these changes to me as soon as they can.
COPYRIGHT
I understand that all Warrior Flow School Training materials are under copyright protection and cannot be reproduced by me without the permission of the author. Warrior Flow School will take all necessary action to enforce its copyrights within the law.
IMAGES
The Student agrees that while participating in any Warrior Flow School program, images, photos or videos may be taken by other Students and/or Warrior Flow School representatives or Third Party Suppliers that may contain or feature the Student. The Student acknowledges that they consent to any such pictures being taken and agree that Student hereby grants a perpetual, royalty-free, worldwide, irrevocable license to Warrior Flow School, its affiliates and assigns, to reproduce for any purpose whatsoever, in any medium whatsoever, without any further obligation to the Student or compensation payable to such Student. If you do not want us to use your image you must submit written notice to [email protected] at least 14 days prior to the start of your training.
MEDICAL AUTHORIZATION AND COVERAGE
WARRIOR FLOW SCHOOL IS NOT LIABLE AND WILL NOT ASSUME RESPONSIBILITY FOR ANY CLAIMS, LOSSES, DAMAGES, COSTS OR EXPENSES ARISING OUT OF INCONVENIENCE, LOSS OF ENJOYMENT, UPSET, DISAPPOINTMENT, DISTRESS OR FRUSTRATION, WHETHER PHYSICAL OR MENTAL, RESULTING FROM THE ACT OR OMISSION OF ANY PARTY OTHER THAN WARRIOR FLOW SCHOOL LLC AND ITS CONTRACTORS.
Release and Waiver of Liability; Assumption of Risk, and Indemnity Agreement
Warrior Flow School LLC and its subsidiaries, parents, and affiliates (collectively, “Warrior Flow School”) may operate studios, live streaming, and pre-recorded video services that provide yoga, and other activities to promote fitness and good health under the Warrior Flow School brand as well as certain other brands, including Warrior Flow.
General Rules
In addition to the rules set forth herein, Warrior Flow School may, from time-to-time, post on Warrior Flow School’s online platforms, or issue orally or in writing, additional rules that the members must obey for general safety reasons and mutually respectful use of the streaming services & other platforms.
Use of Membership
With respect to live streaming or pre-recorded membership options, sharing of your login information and multi user access to content is strictly prohibited and violation of this section will result in suspension or cancellation, with any outstanding balance immediately due and payable and any prepaid fees not subject to refund unless otherwise required by applicable law.
Dress Code
Proper athletic attire is required. Please remember that even when streaming, if you leave your camera on, others may be able to see you so we ask that you dress and behave appropriately. Warrior Flow School has the right to prevent the participation in a class if proper attire is not worn.
Prohibited
Alcohol, drugs (including steroids), and smoking are prohibited while streaming Warrior Flow School services. You agree not to engage in any Warrior Flow School-related activity under the influence of drugs, alcohol or medication that may impair your ability to participate in the applicable activity or operate any equipment. No recording of any livestream or pre-recorded content is permitted at any time without express written consent of Warrior Flow School.
Health Warranty, Assumption of Risk, Waiver of Liability and Release
By electronically signing or otherwise electronically accepting and agreeing to this Agreement, you expressly acknowledge that the use of the classes, or live-streaming or video recordings of Warrior Flow School may involve strength, flexibility, aerobic, cardio and/or other exercises, including the use of equipment, all of which can be potentially hazardous activities that naturally involve the risk of injury to you, whether you or someone else cause it, and you understand and voluntarily accept this risk. In addition, you represent that you are (and at all times moving forward when taking classes or receiving instruction by or through Warrior Flow School) in good health and have no disability, impairment, injury, disease or ailment that would prevent you from safely engaging in active or passive exercise which would cause increased risk of injury or adverse health consequences as a result of engaging in active or passive exercise, and you further acknowledge and understand that it is your duty to notify your Warrior Flow School teacher in advance of each and every class of any changes in your good health. You acknowledge and agree that Warrior Flow School and its team do not diagnose or prescribe treatment for any illnesses or injuries. No service provided by Warrior Flow School is a substitute for medical treatment or care.
You hereby acknowledge and agree that Warrior Flow School will not be liable for any injury, including, without limitation, personal, bodily or mental injury, economic loss or any damage to you, your spouse or partner, guest, unborn child or relatives resulting from the negligence of Warrior Flow School, anyone providing services on Warrior Flow School behalf or anyone else providing livestream or pre-recorded content and you release Warrior Flow School from any liability related to any such injury, including any transmission of sickness, virus, pathogen, or disease. All sessions, classes, performance of any activities provided by Warrior Flow School whether online, through video or stream or otherwise, livestreaming or video, or use of any other Warrior Flow School service shall be at your sole risk. You understand that the decision to use any equipment or apparatus, or the selection of programs, methods and types of equipment, shall be solely your responsibility and Warrior Flow School shall not be liable to you for any claims, demands, damages or causes of actions due to injury to you or your property arising out of or in connection with your use of the services of Warrior Flow School. This waiver of liability and release specifically applies to claims of negligent instruction, maintenance, cleaning, and/or supervision that may arise as a result of injuries sustained before, during, or after classes or individual training sessions. Although Warrior Flow School instructors may provide guidance during a class or individual session, it is your sole responsibility to discontinue participation in any activity you feel is beyond your capability to safely perform and Warrior Flow School will not be responsible for any injuries or damages arising from your engagement in any activities at any Warrior Flow School training regardless of whether they were caused by the negligence of Warrior Flow School, its employees or its agents, trainees, assistants, or mentees. You acknowledge and agree that this waiver of liability and release applies to any and all incidents occurring on any Warrior Flow School owned, operated or controlled premises, including slip or trip and fall incidents, regardless of the cause. You further acknowledge and agree that Warrior Flow School is not liable and does not assume responsibility for any claims, losses, damages, costs or expenses arising out of any inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from any act or omission of Warrior Flow School or any other party. The scope of this waiver of liability and release specifically includes any and all injuries sustained during any event or program organized or operated by Warrior Flow School.
You expressly acknowledge and agree that by electronically signing or otherwise electronically accepting and agreeing to this Agreement you are relinquishing all rights you may have to sue Warrior Flow School for injuries arising out of the use of any Warrior Flow School services.
Waiver of Claims Related to Defective Equipment
You understand and acknowledge that Warrior Flow School does not manufacture any of the fitness or other equipment it recommends. As such, you acknowledge and agree that Warrior Flow School is solely providing recreational services and may not be held liable for defective products.
Waiver of Claims for Third Party Suppliers
From time-to-time, Warrior Flow School makes arrangements with activity providers and other independent parties (“Third Party Suppliers”) to provide you with certain services. Third Party Suppliers may also engage the services of local operators and/or sub-contractors for the provision of services that form part of such programming. Although Warrior Flow School takes all reasonable care in selecting Third Party Suppliers, Warrior Flow School is unable to control Third Party Suppliers, does not supervise Third Party Suppliers and, therefore, cannot be responsible for their acts or omissions. Such services provided are subject to the conditions imposed by the Third Party Suppliers and their liability is limited by their tariffs, conditions of carriage, tickets and vouchers and international conventions and agreements that govern the provision of their services. These may limit or exclude liability of the Third Party Suppliers. You acknowledge that Third Party Suppliers are individually responsible to operate in compliance with the applicable laws of the countries in which they operate and Warrior Flow School does not warrant that any Third Party Supplier is in compliance with the laws of your country of residence or any other jurisdiction.
Other Acknowledgements
You expressly acknowledge and understand that you will be automatically opted into communications from Warrior Flow School and Warrior Flow with regard to the services provided, branding, marketing, or anything else and that it is your duty to opt out through the procedures outlined in such communications. You further expressly acknowledge and understand that your photo and/or video likeness may be used, without limitation, in connection with publicity, copyright, marketing, web content, social media, live stream, recorded classes, or other uses and that permission is expressly granted for such uses, and that no additional consideration outside of the services provided by Warrior Flow School will be provided.
Dispute Resolution
Any controversy or claim arising out of or relating to this Agreement, your use of Warrior Flow School services, streaming products or otherwise, Warrior Flow School’s policies, procedures, practices, marketing, brochures or any other literature concerning Warrior Flow School services or the breach thereof, including, without limitation, any claim related to illness, injury or death, shall be subject to the following conditions: (1) the dispute will be governed by Florida law; (2) the parties agree that they will attempt in good faith to settle any and all disputes arising out of, under or in connection with this Agreement, including, without limitation, the validity, interpretation, performance and breach hereof, through a process of mediation in Florida under the supervision of a mutually agreed upon mediator; (3) in the event that mediation fails to settle such a dispute, the parties agree that they will proceed to arbitration in Warrior Flow School using one arbitrator pursuant to the then existing rules of the American Arbitration Association; (4) the maximum amount of recovery to which you may be entitled under any and all circumstances will be the amount you have paid to Warrior Flow School in the 12 months prior to the date of the claim. This agreement to arbitrate does not waive or modify any liability release agreed to by you. Arbitration against Warrior Flow School must be commenced within one year following the date of the incident giving rise to the claim. Neither Warrior Flow School nor any of its affiliates, employees or agents shall in any case be liable for other than compensatory damages, and you hereby waive any right to punitive damages. Further you expressly acknowledge and agree to waive any rights that you may have to pursue or participate in a class or collective action pertaining to any such claims related to Warrior Flow School.
This Agreement constitutes the entire agreement of the parties with respect to the subject matter hereof and supersedes any prior agreement or understanding between you and Warrior Flow School with respect thereto. Warrior Flow School has made no express or implied warranties or representations other than those expressly set forth in this Agreement to induce you to enter into this Agreement.
Manual, handwritten or oral changes to this Agreement are not valid. Only a written document entitled “Amendment to Membership Agreement” signed by both an authorized representative of Warrior Flow School and you may change the terms of this Agreement. Warrior Flow School employees or contractors are not authorized to make any independent agreements with any member.
If Warrior Flow School does not enforce any right in the Agreement for any reason, Warrior Flow School does not waive its right to enforce it later. Any conflict between the original Agreement and any copy of the original Agreement shall be controlled by the original Agreement.
If any provision of this Agreement is held unenforceable, it is the parties’ intention that such unenforceability shall not affect other provisions of this Agreement.
This Agreement may be executed in one or more original or electronic counterparts, each of which shall be deemed an original, and all of which shall constitute one and the same instrument.
This Agreement applies equally to all Warrior Flow School owned and/or operated facilities & services regardless of brand.
By electronically signing or otherwise electronically accepting and agreeing to this Agreement on your own behalf or as the parent or legal guardian of a minor, you are certifying that you are at least 18 years old and that you have carefully reviewed, fully understand and agree to all provisions of this Agreement. You further understand and agree that you are responsible for all payments described herein.

Estos Términos y Condiciones se aplican a cualquier Actividad de Yoga (ver definición a continuación) comprada en Warrior Flow School (“Warrior Flow School LLC” o “Compañía”) y rigen la relación contractual entre usted (“Usted”, “Yo” o “Estudiante”) y Warrior Flow School con respecto a dichas Actividades.
PARTICIPACIÓN

Para aprovechar al máximo esta experiencia en línea, entiendo que se requiere tener una conexión wifi confiable y una computadora portátil u otro dispositivo funcional para participar en la formación.
Entiendo que debo informar cualquier discapacidad que requiera atención especial en el momento de hacer la reserva. Warrior Flow School hará intentos razonables para acomodar las necesidades de cualquier participante, pero no es responsable en caso de que no pueda hacerlo.
REQUISITO DE EDAD DEL CLIENTE

Se requiere el pago completo antes del inicio del programa, a menos que se haya acordado un plan de pago.
Si cancela 8 o más días antes del inicio del programa, recibirá un reembolso completo. Si cancela dentro de los 7 días previos al inicio del programa, perderá el 10% de su pago total y el saldo restante será reembolsado. Este 10% no es reembolsable ni transferible. Una vez que comienza el programa, la matrícula completa del programa no es reembolsable ni transferible.
Entendemos que las circunstancias de la vida pueden dificultar su participación en la formación según lo esperado. Tiene la posibilidad de trasladarse a una cohorte futura (realizamos la formación varias veces al año) por una tarifa única no reembolsable del 10% del precio regular. En las raras ocasiones en que Warrior Flow School necesite cancelar una formación, se proporcionará un reembolso completo.
La formación debe completarse como máximo 30 días después de la fecha oficial de finalización de la formación.
Si no puede completar la formación durante este período de tiempo, puede solicitar una extensión para finalizar la formación y recibir su diploma, o puede trasladarse a otra cohorte (ver arriba).

CAMBIOS
Warrior Flow School se reserva el derecho de cambiar, alterar o modificar el programa, incluyendo, sin limitación, el plan de estudios de cada formación en cualquier momento. Warrior Flow School hará sus mejores esfuerzos para comunicar estos cambios tan pronto como sea posible.
DERECHOS DE AUTOR
Entiendo que todos los materiales de formación de Warrior Flow School están protegidos por derechos de autor y no pueden ser reproducidos por mí sin el permiso del autor. Warrior Flow School tomará todas las acciones necesarias para hacer cumplir sus derechos de autor dentro de la ley.
IMÁGENES

El Estudiante reconoce que consiente en que se tomen dichas imágenes y acepta que el Estudiante otorga por la presente una licencia perpetua, libre de regalías, mundial e irrevocable a Warrior Flow School, sus afiliados y cesionarios, para reproducir con cualquier propósito, en cualquier medio, sin ninguna obligación adicional para el Estudiante ni compensación pagadera a dicho Estudiante. Si no desea que usemos su imagen, debe enviar un aviso por escrito a [email protected] al menos 14 días antes del inicio de su formación.
AUTORIZACIÓN MÉDICA Y COBERTURA
WARRIOR FLOW SCHOOL NO ES RESPONSABLE Y NO ASUMIRÁ RESPONSABILIDAD POR NINGUNA RECLAMACIÓN, PÉRDIDA, DAÑO, COSTO O GASTO DERIVADO DE INCONVENIENTES, PÉRDIDA DE DISFRUTE, MOLESTIA, DECEPCIÓN, ESTRÉS O FRUSTRACIÓN, YA SEA FÍSICA O MENTAL, RESULTANTES DEL ACTO U OMISIÓN DE CUALQUIER PARTE QUE NO SEA WARRIOR FLOW SCHOOL LLC Y SUS CONTRATISTAS.
Exoneración y Renuncia de Responsabilidad; Asunción de Riesgos y Acuerdo de Indemnización
Warrior Flow School LLC y sus subsidiarias, matrices y afiliadas (colectivamente, “Warrior Flow School”) pueden operar estudios, servicios de transmisión en vivo y servicios de video pregrabados que proporcionan yoga y otras actividades para promover el fitness y la buena salud bajo la marca Warrior Flow School, así como ciertas otras marcas, incluyendo Warrior Flow.
Reglas Generales
Además de las reglas establecidas en este documento, Warrior Flow School puede, de vez en cuando, publicar en las plataformas en línea de Warrior Flow School o emitir oralmente o por escrito, reglas adicionales que los miembros deben obedecer por razones de seguridad general y uso respetuoso mutuo de los servicios de transmisión y otras plataformas.
Uso de Membresía

Código de Vestimenta
Se requiere ropa deportiva adecuada. Recuerde que incluso cuando transmita, si deja su cámara encendida, otros pueden verlo, por lo que le pedimos que se vista y se comporte adecuadamente. Warrior Flow School tiene el derecho de evitar la participación en una clase si no se usa la ropa adecuada.
Prohibido
Está prohibido el alcohol, las drogas (incluyendo esteroides) y fumar mientras se transmiten los servicios de Warrior Flow School. Usted acepta no participar en ninguna actividad relacionada con Warrior Flow School bajo la influencia de drogas, alcohol o medicamentos que puedan afectar su capacidad para participar en la actividad aplicable o operar cualquier equipo. No se permite la grabación de ningún contenido en vivo o pregrabado en ningún momento sin el consentimiento expreso por escrito de Warrior Flow School.
Garantía de Salud, Asunción de Riesgo, Renuncia de Responsabilidad y Liberación
Al firmar electrónicamente o aceptar y acordar electrónicamente este Acuerdo, usted reconoce expresamente que el uso de las clases, o la transmisión en vivo o grabaciones de video de Warrior Flow School puede involucrar ejercicios de fuerza, flexibilidad, aeróbicos, cardio y/o otros, incluyendo el uso de equipos, todos los cuales pueden ser actividades potencialmente peligrosas que naturalmente implican el riesgo de lesiones para usted, ya sea que usted u otra persona lo cause, y usted entiende y acepta voluntariamente este riesgo. Además, usted declara que se encuentra (y siempre lo estará mientras tome clases o reciba instrucción por medio de Warrior Flow School) en buen estado de salud y no tiene ninguna discapacidad, impedimento, lesión, enfermedad o dolencia que le impida participar de manera segura en ejercicio activo o pasivo que podría causar un mayor riesgo de lesiones o consecuencias adversas para la salud como resultado de participar en ejercicio activo o pasivo, y además reconoce y entiende que es su deber notificar a su maestro de Warrior Flow School antes de cada clase sobre cualquier cambio en su buen estado de salud. Usted reconoce y acepta que Warrior Flow School y su equipo no diagnostican ni prescriben tratamiento para ninguna enfermedad o lesión. Ningún servicio proporcionado por Warrior Flow School es un sustituto del tratamiento médico o la atención médica.
Usted reconoce y acepta que Warrior Flow School no será responsable por ninguna lesión, incluyendo, sin limitación, lesión personal, corporal o mental, pérdida económica o cualquier daño a usted, su cónyuge o pareja, invitado, hijo no nacido o parientes resultante de la negligencia de Warrior Flow School, cualquier persona que proporcione servicios en nombre de Warrior Flow School o cualquier otra persona que proporcione contenido en vivo o pregrabado y usted libera a Warrior Flow School de cualquier responsabilidad relacionada con dicha lesión, incluyendo cualquier transmisión de enfermedad, virus, patógeno o enfermedad. Todas las sesiones, clases, desempeño de cualquier actividad proporcionada por Warrior Flow School, ya sea en línea, a través de video o transmisión en vivo, o el uso de cualquier otro servicio de Warrior Flow School será bajo su propio riesgo. Usted entiende que la decisión de usar cualquier equipo o aparato, o la selección de programas, métodos y tipos de equipos, será su responsabilidad exclusiva y Warrior Flow School no será responsable ante usted por ninguna reclamación, demanda, daños o causas de acción debido a lesiones para usted o su propiedad que surjan de o en conexión con su uso de los servicios de Warrior Flow School. Esta renuncia de responsabilidad y liberación se aplica específicamente a las reclamaciones por instrucción negligente, mantenimiento, limpieza y/o supervisión que puedan surgir como resultado de lesiones sufridas antes, durante o después de clases o sesiones de entrenamiento individuales. Aunque los instructores de Warrior Flow School pueden proporcionar orientación durante una clase o sesión individual, es su responsabilidad exclusiva interrumpir la participación en cualquier actividad que sienta que está más allá de su capacidad para realizarla de manera segura y Warrior Flow School no será responsable por ninguna lesión o daño que surja de su participación en cualquier actividad en cualquier formación de Warrior Flow School, independientemente de si fueron causados por la negligencia de Warrior Flow School, sus empleados o sus agentes, aprendices, asistentes o mentorados. Usted reconoce y acepta que esta renuncia de responsabilidad y liberación se aplica a todos y cada uno de los incidentes que ocurran en cualquier instalación propiedad, operada o controlada por Warrior Flow School, incluyendo incidentes de resbalones o tropiezos y caídas, independientemente de la causa. Usted también reconoce y acepta que Warrior Flow School no es responsable y no asume responsabilidad por ninguna reclamación, pérdida, daño, costo o gasto que surja de cualquier inconveniente, pérdida de disfrute, molestia, decepción, estrés o frustración, ya sea física o mental, resultante de cualquier acto u omisión de Warrior Flow School o cualquier otra parte. El alcance de esta renuncia de responsabilidad y liberación incluye específicamente todas y cada una de las lesiones sufridas durante cualquier evento o programa organizado u operado por Warrior Flow School.
Usted reconoce y acepta expresamente que al firmar electrónicamente o aceptar y acordar electrónicamente este Acuerdo está renunciando a todos los derechos que pueda tener para demandar a Warrior Flow School por lesiones que surjan del uso de cualquier servicio de Warrior Flow School.
Renuncia de Reclamaciones Relacionadas con Equipos Defectuosos
Usted entiende y reconoce que Warrior Flow School no fabrica ninguno de los equipos de fitness u otros equipos que recomienda. Como tal, usted reconoce y acepta que Warrior Flow School está proporcionando únicamente servicios recreativos y no puede ser considerado responsable por productos defectuosos.
Renuncia de Reclamaciones para Proveedores Terceros
De vez en cuando, Warrior Flow School hace arreglos con proveedores de actividades y otras partes independientes (“Proveedores Terceros”) para proporcionarle ciertos servicios. Los Proveedores Terceros también pueden contratar los servicios de operadores locales y/o subcontratistas para la prestación de servicios que forman parte de dicha programación. Aunque Warrior Flow School toma todas las precauciones razonables al seleccionar Proveedores Terceros, Warrior Flow School no puede controlar a los Proveedores Terceros, no supervisa a los Proveedores Terceros y, por lo tanto, no puede ser responsable de sus actos u omisiones. Dichos servicios proporcionados están sujetos a las condiciones impuestas por los Proveedores Terceros y su responsabilidad está limitada por sus tarifas, condiciones de transporte, boletos y vales y convenciones y acuerdos internacionales que rigen la prestación de sus servicios. Estos pueden limitar o excluir la responsabilidad de los Proveedores Terceros. Usted reconoce que los Proveedores Terceros son individualmente responsables de operar de acuerdo con las leyes aplicables de los países en los que operan y Warrior Flow School no garantiza que ningún Proveedor Tercero cumpla con las leyes de su país de residencia o cualquier otra jurisdicción.
Otros Reconocimientos
Usted reconoce y entiende expresamente que será automáticamente incluido en las comunicaciones de Warrior Flow School y Warrior Flow con respecto a los servicios proporcionados, branding, marketing o cualquier otra cosa y que es su deber optar por no recibir dichas comunicaciones a través de los procedimientos establecidos en dichas comunicaciones. Usted también reconoce y entiende expresamente que su foto y/o imagen de video puede ser utilizada, sin limitación, en conexión con publicidad, derechos de autor, marketing, contenido web, redes sociales, transmisión en vivo, clases grabadas u otros usos y que se concede permiso expresamente para dichos usos, y que no se proporcionará ninguna consideración adicional fuera de los servicios proporcionados por Warrior Flow School.
Resolución de Disputas
Cualquier controversia o reclamación que surja de o esté relacionada con este Acuerdo, su uso de los servicios de Warrior Flow School, productos de transmisión o de otro tipo, políticas, procedimientos, prácticas, marketing, folletos o cualquier otra literatura relacionada con los servicios de Warrior Flow School o su incumplimiento, incluyendo, sin limitación, cualquier reclamación relacionada con enfermedad, lesión o muerte, estará sujeta a las siguientes condiciones: (1) la disputa se regirá por las leyes de Florida; (2) las partes acuerdan que intentarán de buena fe resolver todas las disputas que surjan de, bajo o en relación con este Acuerdo, incluyendo, sin limitación, la validez, interpretación, desempeño e incumplimiento del mismo, a través de un proceso de mediación en Florida bajo la supervisión de un mediador mutuamente acordado; (3) en el caso de que la mediación no resuelva dicha disputa, las partes acuerdan que procederán al arbitraje en Warrior Flow School utilizando un árbitro de acuerdo con las reglas vigentes de la Asociación Americana de Arbitraje; (4) la cantidad máxima de recuperación a la que usted puede tener derecho en cualquier circunstancia será la cantidad que haya pagado a Warrior Flow School en los 12 meses anteriores a la fecha de la reclamación. Este acuerdo de arbitraje no renuncia ni modifica ninguna liberación de responsabilidad acordada por usted. El arbitraje contra Warrior Flow School debe comenzar dentro de un año posterior a la fecha del incidente que da lugar a la reclamación. Ni Warrior Flow School ni ninguno de sus afiliados, empleados o agentes serán responsables en ningún caso de daños compensatorios, y usted renuncia por la presente a cualquier derecho a daños punitivos. Además, usted reconoce y acepta expresamente renunciar a cualquier derecho que pueda tener para perseguir o participar en una acción colectiva relacionada con cualquier reclamación relacionada con Warrior Flow School.
Este Acuerdo constituye el acuerdo completo entre las partes con respecto al objeto del mismo y reemplaza cualquier acuerdo o entendimiento previo entre usted y Warrior Flow School con respecto al mismo. Warrior Flow School no ha hecho ninguna garantía expresa o implícita o representaciones más allá de las expresamente establecidas en este Acuerdo para inducirlo a entrar en este Acuerdo.
Los cambios manuales, escritos a mano o verbales a este Acuerdo no son válidos. Solo un documento escrito titulado “Enmienda al Acuerdo de Membresía” firmado tanto por un representante autorizado de Warrior Flow School como por usted puede cambiar los términos de este Acuerdo. Los empleados o contratistas de Warrior Flow School no están autorizados para hacer acuerdos independientes con ningún miembro.
Si Warrior Flow School no hace cumplir algún derecho en el Acuerdo por cualquier motivo, Warrior Flow School no renuncia a su derecho a hacer cumplir dicho derecho posteriormente. Cualquier conflicto entre el Acuerdo original y cualquier copia del Acuerdo original se regirá por el Acuerdo original.
Si alguna disposición de este Acuerdo se considera inaplicable, es la intención de las partes que dicha inaplicabilidad no afecte otras disposiciones de este Acuerdo.
Este Acuerdo puede ser ejecutado en una o más copias originales o electrónicas, cada una de las cuales se considerará un original, y todas juntas constituirán un solo y mismo instrumento.
Este Acuerdo se aplica igualmente a todas las instalaciones y servicios propiedad y/o operados por Warrior Flow School, independientemente de la marca.
Al firmar electrónicamente o aceptar y acordar electrónicamente este Acuerdo en su propio nombre o como padre o tutor legal de un menor, usted certifica que tiene al menos 18 años de edad y que ha revisado cuidadosamente, comprende completamente y acepta todas las disposiciones de este Acuerdo. Además, entiende y acepta que es responsable de todos los pagos descritos en este documento.
